THE COLLECTION PROCESS – (Knowledge is Power)

When an account arrives at CCS from one of its clients, the file is thoroughly reviewed by
management. The purpose of the review is to gather the data necessary to identify the
legally responsible party as well as the financial status of that party.  This information is
used as a starting point for a detailed investigation of the debtor. CCS utilizes a number of
on-line sources to obtain raw data that can then be analyzed and cross-referenced in order
to glean an accurate picture of the debtor and the debtor’s assets. Skip tracing is also
performed during this initial stage in the event the debtor has moved and relocated. This
helps determine an individualized collection strategy, which, in turn, sets the course of the
collection procedures to be used.

THE CCS ADVANTAGE- (Cut to the Chase)

Unlike traditional “boiler-room” collection operations, CCS emphasizes the use of action to
motivate debtors as opposed to a reliance on simple repetitive phone contacts and
DUNNING letters.  Alhough calls and letters do have their place, they are insufficient if they
are not backed by real consequences for nonpayment. Therefore, CCS ascribes to a
methodology geared towards legal action.

CCS maintains an in-house legal department to expedite the process of litigation. This
allows us greater efficiency and flexibility.  The key to a successful legal collection is speed
and accuracy. This is the product of several components starting with the initial
investigation and analysis of an account.

Suing the wrong entity or person is a waste of time, so identification of the proper defendant
is critical. Additionally, each case requires timely follow up in order to keep the file from
languishing in the court system.

Finally, each case should be brought to its proper disposition. CCS’s attorneys use a series
of legal procedures to ensure that a lawsuit is not derailed by dilatory tactics employed by a
defendant’s counsel.  For instance, prejudgment writs of attachment and motions for
summary judgment are effective tools used by CCS on a regular basis. Each of these
strategic moves forces defendants to face the reality of paying their attorney to defend the
indefensible. This results in strong motivation to pay off the account.

A KINK IN THE ARMOR

One of the recent challenges in the world of commercial collections is the use of legal
fictions, such as Corporations and LLP’s, to insulate individuals from personal liability.
Although there are perfectly proper uses of such entities, some are simply a guise to shift
the risk of doing business to vendors. In other words, sometimes a corporate entity is used
as a means of protecting unsavory individuals who loot corporate assets for their own
benefit rather than paying creditors. The entity is left as a shell without any assets for
creditors to pursue.

CCS has developed procedures designed to pierce the corporate veil and impute liability to
the principals. In many cases, these individuals tender payment to avoid the possibility that
their liability might become public record, thereby inviting other creditors to follow suit.

LOSING IS HALF THE BATTLE...TOO!

Many consider obtaining judgment against a debtor as a win. However, a judgment by itself
is no guaranty of recovery. That’s why CCS focuses on the whole battle. Upon the granting
of Judgment, CCS immediately sets its sights on recovery through levies and liens, as well
as persuasion. In the event an asset is disposed of, CCS gears up to locate new assets.
Additionally, all property transfers are scrutinized to determine whether they are legitimate
or simply a rouse to conceal assets. In the later case, CCS will undertake action against the
transferee in order to recover the transferred assets.


THAT PERSONAL TOUCH

In addition to its comprehensive collection procedures, CCS takes pride in providing its
clients the personal attention they deserve. Although general status reports are sent to
clients on a regular basis, more detailed reports can be provided upon request. Inquiries
from clients are always given a priority status and questions about particular cases or
general advice are fair game. Final demand letters, write-off reviews and debtor profiles are
also available.
